1. General Provisions

These Terms of Use (the “Terms”) govern the use of the mobile application BrainGames (the “App”) and define the rights and obligations of users. By downloading, installing, or using the App, you agree to comply with these Terms.

2. Service Description

The App provides short games (such as memory tasks, math problems, word games and the Stroop test) for entertainment and general cognitive training. Every day the App offers a daily workout of 3 games. The App keeps your game results, your streak and your progress over time on your device.

Medical Disclaimer:

The App is not a medical device. It is intended solely for entertainment and general cognitive training. It is not designed to diagnose or treat any medical condition, and it does not cure or prevent dementia, Alzheimer’s disease, or other cognitive impairments. We do not promise any health benefit from using the App. Please consult a healthcare professional for medical advice.

3. User Rights and Obligations

You have the right to:

• Use the features of the App available to you in accordance with these Terms: the free daily workout, or all games with a Premium subscription.
• Track your personal progress within the App.
• Manage or cancel your subscription in your Apple Account settings.
• Restore your purchases in the App.
• Contact support regarding technical or subscription-related issues.

You agree to:

• Use the App only in a lawful manner.
• Not use the App for illegal activities, fraud, or the distribution of malware.
• Not attempt to reverse engineer, decompile, or hack the App’s code or statistics.
• Not use the App in any way that could damage, disable, or impair the service.

4. Subscriptions and Payments

• Free version: every day, the daily workout of 3 games is free.
• Premium: a Premium subscription opens all 6 games of the App at any time.
• Subscription options: a monthly subscription with a 3-day free trial, a monthly subscription without a trial, and an annual subscription. The options available to you and their prices are shown in the App before you subscribe.
• Free trial: if you start a subscription with a free trial, it automatically becomes a paid subscription at the end of the trial unless you cancel it at least 24 hours before the trial ends.
• Billing: payment is charged to your Apple Account through the App Store when you confirm the purchase, or when the free trial ends.
• Auto-Renewal: subscriptions renew automatically for the same period unless canceled at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the end of the current period.
• Management: you manage and cancel your subscription in your Apple Account settings on your device. If you have Premium, the App’s settings have a “Manage subscription” button that opens these settings. We cannot cancel your subscription for you.
• Cancellation: you can cancel your subscription at any time. The cancellation takes effect at the end of the current paid period.
• Restoring purchases: if you reinstall the App or use a new device with the same Apple Account, use “Restore purchases” in the App’s settings or on the subscription screen.
• Refunds: refunds are governed exclusively by Apple’s App Store refund policy.
• Price Changes: subscription prices may change. Apple notifies you in advance as required by its rules. Changes do not affect periods you have already paid for.

5. Intellectual Property

• All rights to the App, its source code, interface, graphics, game mechanics, and materials belong to the developer and are protected by copyright laws.
• Trademarks and logos belong to their respective owners.
• Copying, modifying, or distributing the App or its components without prior written permission is prohibited.

6. Limitation of Liability

• The App is provided on an “as is” and “as available” basis.
• We do not guarantee that the App will meet your specific requirements or that specific cognitive results will be achieved through its use.
• We are not responsible for interruptions in service availability due to technical maintenance or third-party (App Store) issues.
• Our liability is limited to the amount paid by you for the subscription (if applicable). We are not liable for any indirect, incidental, or consequential damages.

7. Termination of Use

• You may stop using the App at any time by deleting it from your device.
• Deleting the App does not automatically cancel your subscription. You must cancel it separately in your Apple Account settings.
• We reserve the right to suspend or terminate your access to the App if you violate these Terms (e.g., attempting to hack the game logic).

8. Changes to the Terms

We reserve the right to update these Terms of Use. The updated Terms are published on this page, and the date at the top shows the latest version. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

Support assists users with app functionality, resolving technical bugs, and handling subscription-related questions.

10. Governing Law
